The Plaintiff in the action The Lamar Co. was seeking to enforce a 1998 Settlement Agreement that would have allowed them to build new billboards within the City of Columbia without complying with the City's Sign Ordinances and ask the court to grant a mandamus forcing the city officials to issue the permits. The Circuit Court of Boone county found the 1998 agreement “void” and in violation of Sec. 432. 070 RSMo. as attempting to contract away the City's police powers which is a violation of the statute.
