Overview: Process Servers
Nothing in a lawsuit moves until the other side has been served, and served in a way the court will accept. That is the whole trade. A process server hands over summonses, complaints, subpoenas, eviction notices and family court papers, records every attempt, then swears an affidavit of service that becomes the proof on the file. Many agencies also file documents at the courthouse, retrieve copies, and skip trace a person nobody can locate. These are service agencies rather than law firms, and none of them gives legal advice.
Rules differ by state, and sometimes by county. Some states require a server to be licensed or registered; elsewhere any adult who is not a party to the case may do it. Ask which counties an agency covers, how attempts are logged, what it does when the person will not come to the door, and who notarizes the affidavit before it reaches you.
Have the papers as the court issued them, the full legal name, every address you hold, a workplace, a physical description and a vehicle if you know it.

What does process service cost?
Request a price for one named recipient at one address, with a defined number of attempts and proof of service. Faster service usually means an earlier first attempt; it does not guarantee the person will be found or served.

What does a process server actually do?
Delivers legal documents to a named person and then proves it happened. The proof is the point. A server logs each attempt, notes the date, the place and who answered the door, and signs a sworn affidavit of service that goes on the court file. Many agencies also file your papers at the courthouse, pull certified copies, and trace people who have moved.
Who is allowed to serve court papers?
It depends on the state, and sometimes on the county. Several states license or register process servers and require a bond; in others any competent adult who is not a party to the case may serve, which is why friends and relatives sometimes do it badly. A professional server knows the local practice and produces an affidavit the clerk will accept without argument.
What happens if someone keeps avoiding being served?
The server keeps attempting at different times of day and records each one, because a pattern of failed attempts is what supports the next step. Most states then allow substituted service: leaving the papers with a suitable adult at the home or workplace, sometimes with a mailed copy, and in some situations posting by court order. Rules differ by state.
How do process servers price a service job?
Usually a flat fee per person served, covering a set number of attempts, with extra attempts, distant addresses and rush handling billed on top. Court filing and skip tracing are normally priced separately. Ask what counts as an attempt, what happens if the address turns out to be wrong, and whether you still pay when service cannot be completed.
Do process servers trace people who cannot be found?
Many do, and they call it skip tracing: database searches, credit header data where a permissible purpose exists, public records, and a knock on a former neighbor's door. That is as far as it goes. Watching a person, documenting behavior, running an asset search or building evidence for a case is investigation work, and it is a separate trade with its own licensing.
Does a process server enforce judgments or collect debts?
No. Serving papers and enforcing an order are separate roles. A judgment is enforced by the sheriff, a marshal or a licensed collection agency depending on the state and the type of order. Some agencies offer both under one roof, which is convenient, but the enforcement side answers to different rules. Ask which part you are actually buying.
