Officers conducting a dishonest vehicle search may not coerce consent to search by means of threatening to tow the car. The Court of Appeal in Boitez ruled this week that: “The Fourth and Fourteenth Amendments require that a consent not be coerced, by explicit or implicit means, by implied threat or covert force.” (Schneckloth v. Bustamonte, 412 US 218, 228.) The Court ruled, “the false promise of leniency not to tow the car was a material and inextricable part of the agreement inducing defendant’s consent to the search, and thus, under the totality of the circumstances, defendant’s consent was not voluntarily given.” Evidence suppressed.
