Mediation is a private process where a mediator, who is a neutral third-party, is formally trained to identify and understand legal issues and to facilitate and to structure negotiations between the parties. The goal is to try to resolve the parties' dispute. While courts can mandate that certain cases go to mediation, the process remains “voluntary” in that the parties are not required to come to agreement. Even if you have already tried to talk it out or negotiate with the other party, a mediator can help you and the other party listen to each other and keep you focused. A mediator is there to help both sides communicate and explore possible solutions.
