DID YOU KNOW that a complicated divorce can also give rise to an action for child custody? The court may award any of the five (5) categories of physical custody (i.e., shared, primary, partial, sole or supervised) and either of the two (2) categories of legal custody (i.e., shared or sole), as long as it is in the best interest of the child. For a person to file for “any form of physical or legal custody”, the person must satisfy one of the following requirements: (1) A parent of the child. (2) A person who stands in loco parentis to the child. (3) A grandparent of the child who is not in loco parentis.
