
A probate hearing usually arises when a person dies and has left behind assets or property where it was not held in trust for the decedent. Generally, it is preferable to hold assets in a trust, where the probate process may be avoided. However, where there is no will, or a will but no trust, the probate process is available to assist a decedent's relatives to properly and legally obtain title to their loved one's property, including bank accounts, vehicles, money, real estate, and other assets. The probate process will also include the validation of a will. In case of any contest arising from the will, the courts will decide on the will's validity through a probate proceeding. Some assets need not go through the probate process, and can be passed down without any probate at all....
