The State dismissed their case against our client charged with felony possession with intent to distribute cocaine.Our client was a passenger in a friend’s car when they were pulled over for what officer’s claimed was an illegal tint on the windows and a non-matching paper license plate. Officers ordered everyone out of the car and began searching them, finding cocaine on our client. Under the circumstances, the law only allowed officers to conduct a “Terry Frisk,” a pat-down of the outer clothing, to check for weapons in order to protect officers while they continue their investigation. Officers could only conduct the search if they had articulable facts to believe the person is armed. Body camera video showed the officers went beyond what the law allows for a pat-down and contradicted much of what the officers wrote in their reports. Clay S. Conrad and Wade B. Wade further questioned one of the officers whose body camera showed him reaching his hand between our client’s legs, beneath his genitals where he cupped, squeezed and rubbed back and forth several times in order to discover the contraband.
