김변호사의 월간(月刊) 이민법 12월호 1. 2023년 1월 이민비자 문호 2023년 1월 Visa Bulletin 이 발표되었습니다. 안타깝게도 2022년 12월 이민문호와 거의 모든 우선일자가 동결입니다. 결과적으로 한달씩 늦어졌다고 봐야겠죠. 가족초청은 특이사항이 없고, 취업이민 3순위 비숙련이민의 경우 Final Action Date 가 2020년 6월 1일, Date For Filing 이 2022년 9월 8일입니다. 최종적인 영주권승인일은 여전히 2년 이상의 대기가 걸려 있습니다. 다행인 것은, 내년에도 I-485 접수는 Date For Filing 차트에 의해 받기로 발표되었습니다. 따라서 비숙련으로 진행하신 분들이 영주권 신청서 I-485 접수는 대기없이 할수 있어서 학생비자 등의 유지 부담은 없습니다. 취업이민 2순위는 이례적으로 몇달씩의 대기기간이 생긴 것 처럼 보이지만, 실제로는 LC 의 우선일자가 그 보다는 과거이기 때문에 사실상으로는 대기기간이 없습니다. LC 절차를 밟지 않는NIW 2순위 취업이민의 경우에만 동시접수가 안되는 상황입니다. 2. Labor Certification 심사 기간 장기화 추세 취업이민에 있어 이민국은 140 의 속행절차를 확대하고 485의 처리속도를 2023년 회계년도까지 6개월로 줄이기로 하는 등 전체적으로 호의적입니다. 하지만 이민국에 서류를 접수하기 전에 거치는 연방노동부의 PERM L/C 절차는 개별 단계마다 계속 심사기간이 길어지고 있습니다. 적정임금(PWD)의 처리는 이제는 8개월 정도 걸리고, 구인 절차 뒤에 온라인으로 접수한 L/C 의 심사 기간도 8개월 전후입니다. 그러다 보니, 이제는 LC 전체기간은 감사가 없어도 거의 1년 반, 감사시에는 2년정도 걸리게 된 상황인 점은 이해하시고, 조급한 마음을 갖지 마시기 바랍니다.
