BURIAL PLANNING It has always been advisable to pre-plan the funeral and burial activities. This minimizes the ability of others to persuade the use of expensive and flamboyant activities surrounding the ceremonies of a loved family member. While there are examples of extravagant funerals or burials (such as “bury me with my car”), most individuals want to have a simple and cost-effective funeral and burial. Planning this proceeding yourself also removes the burden from your successors and eliminates potential arguments surrounding the activities and costs. Now, for those who do plan for their future burial, there exists a new law which can impact your intentions. Some well-meaning parents will purchase burial lots, plots, or similar remains residences which are not fully utilized by the purchaser. Any remaining interests or rights are not subject to a need for a deed, but Section 8650 of the California Health and Safety Code, requires that any such interests or rights be designated in a Will or a Trust. If specific reference is not made to such rights, the interest will pass to a person determined by the Health and Safety Code which may be someone other than the person you would choose.
