BEWARE OF JOINTLY TITLED BANK ACCOUNTS While it is true that jointly titled bank accounts do avoid probate (at least on the first account holder's passing), the risks may outweigh the benefits. The big risk with jointly titled accounts is that all of the funds in the account are susceptible to all account owners' creditors. That means that if Bob and Jenny are account holders, and Jenny has deposited 100% of the assets, while Bob has contributed 0%, and if Bob is in a car accident and is suddenly liable for damages, the claimants can reach the full account. While probate is no picnic, and ordinarily is something to avoid, the benefits here would not outweigh the risks. Moreover, if there is a situation where one person needs assistance with their account, say an elderly parent needs to pay bills, drafting a power of attorney is likely a safer bet than including someone else as an owner.
