Your are allowed to keep your home in bankruptcy, however there is a cap on equity. If you have a home with equity, it is much easier to file Chapter 7. A few years ago, the State of California passed legislation allowing a person in Los Angeles County to file a Chapter 7 Bankruptcy if you have less than $600,000 equity, $300,000 to $600,000 in other counties. Limitation on $600,000 exemption. If you acquired the home within the past 1215 days prior to filing bankruptcy, your home exemption is limited to $170,350.00. Therefore, if you purchased your home 600 days ago and you file bankruptcy and your equity is $400,000.00, the trustee will challenge your exemption claiming there is entitle too $229,650 which he can use to pay your creditors.
