People v. Romero authorizes a judge to dismiss a prior "strike" offense for purposes of sentencing on a new case. (Romero, 13 Cal.4th 148). To do so, the Court must verbalize exactly why it would be in the interest of justice. Last week, the Beasley Court overruled a judge's use of this discretion, and noted that the "age of the prior strike" was not a valid factor when the defendant had spent nearly all of it incarcerated. The time spend in custody cannot form the basis for a history of good-behavior for purposes of excluding a prior offense.
